Between the company DUNE PARAPENTE under SIRET number 941 273 187 00018, represented by Mr Pierre-Evelyn JACOB in his capacity as Chairman, duly authorized for the purposes hereof.

Hereinafter the "Seller" or the "Company".

On the one hand,

The individual or legal entity purchasing the service (paragliding gift voucher) from the company,

Hereinafter referred to as "the Buyer", "the Purchaser", or "the Customer".

On the other hand,

And the individual beneficiary of the company's paragliding gift voucher,

Hereinafter "the Beneficiary

from Third share, 

It has been explained and agreed as follows:

PREAMBLE

These general terms and conditions of sale set out the terms of the contract between the Customer and Dune-Parapente for the sale of paragliding gift vouchers. Exclusively marketed through its website (https://www.dune-parapente.com ) as well as the rules governing the use of the gift voucher by the beneficiary.

The list and description of the services offered by the Company can be consulted on the above-mentioned website.

ARTICLE 1 Purpose

The present General Terms and Conditions of Sale determine the rights and obligations of the parties in the context of the online sale of paragliding gift vouchers offered by the Seller and form an integral part of the Contract between the Buyer and the Seller.

By placing an order, the Purchaser acknowledges having read and expressly accepted these terms and conditions and having informed the beneficiary of the voucher, who also expressly acknowledges this.

The Vendor reserves the right to modify these terms and conditions at any time by publishing a new version on its website. The terms and conditions applicable shall be those in force on the date of payment (or of the first payment in the case of multiple payments) of the order.

The Customer declares that he/she is legally capable of contracting under French law or that he/she validly represents the individual or legal entity on whose behalf he/she is contracting.

The purchaser, having taken knowledge of the services offered, their characteristics and their constraints, has under his sole responsibility and according to his needs as determined before any order, made his choice on the services that are the subject of his order. In addition, the purchaser alone is aware of the physical conditions of the beneficiary of the gift voucher, and is the sole judge of the compatibility of the services requested with the beneficiary's physical conditions. 

ARTICLE 2 Prices

All prices include VAT.

Buyers can pay for their gift vouchers by credit card.

Application fee :

A processing fee of 80 euros (incl. VAT) is applied to all Baptism gift voucher orders. This fixed fee covers the processing of the order and the cost of organizing appointment requests.

In the event of a gift voucher being reimbursed for an exceptional reason (illness, death), Dune-Parapente retains the fixed costs.

The Company reserves the right to modify its prices at any time in the future.

ARTICLE 3 Online contract conclusion

The online contract complies with the provisions of article 1127-1 of the French Civil Code.

ARTICLE 4 Products and services

The essential characteristics of the paragliding gift vouchers, their respective prices and how to use them are made available to the purchaser on the company's website, 

Contractual information is presented in detail and in French. The period of validity of the gift vouchers and their prices are specified on the Company's website in these general terms and conditions of sale.

ARTICLE 5 Conformity

The services offered comply with the provisions of article L.411-1 of the French Consumer Code,  

ARTICLE 6 Retention of title

The products offered remain the property of the Company until full payment has been received.

ARTICLE 7: Payment

Payment is due immediately upon ordering

The customer may pay by credit card.

Cards issued by banks domiciled outside France must be international bank cards (Mastercard or Visa).

Secure online payment by credit card is carried out by our payment service provider. The information transmitted is encrypted and cannot be read during transport on the network. 

Once payment has been initiated by the customer, the transaction is immediately debited once the information has been verified. In accordance with the provisions of the French Monetary and Financial Code, the commitment to pay by card is irrevocable. By providing his/her bank details at the time of sale, the Customer authorizes the Vendor to debit his/her card for the amount relating to the price indicated. The Customer confirms that he/she is the legal holder of the card to be debited and that he/she is legally entitled to use it. In the event of an error, or if it is impossible to debit the card, the Sale is immediately cancelled and the order cancelled.

ARTICLE 8 Withdrawal period

Concerning only the sale of gift vouchers, and in accordance with Article L.221-18 of the French Consumer Code, the consumer has a period of 14 working days from the date of delivery of the order to return the voucher and request an exchange or refund without penalty.

ARTICLE 9 Period of validity 

Gift vouchers are valid for one year from the date of purchase, subject to the opening dates, which are generally from the beginning of April to the end of September each year.

There is no possibility of extending the validity of the gift voucher, and the gift voucher will be totally lost and will not be eligible for partial reimbursement after its validity date.

As a reminder, partial reimbursement of gift vouchers is not possible, except for exceptional reasons (illness, death) duly justified by the beneficiary.

Baptisms are performed between April and September. 

Please note that the validity period is calculated on the day the service is provided, not on the day you book online.

Examples: 

- If you purchase your gift voucher on January 15, 2022, you can fly during the opening period, i.e. from April to the end of September 2022.

- If you purchase your gift voucher on July 25, 2022, you can fly during the opening period, i.e. from July 25, 2022 to the end of September 2022 and from April 1, 2023 to July 25, 2023.

Article 10 Special conditions and features of the service

In view of the specific nature of the activity offered, which is highly dependent on weather conditions, it is expressly agreed and accepted by the purchasing customer that the beneficiary of the order form must be able to attend several times during the season, given the risk of cancellation and/or postponement of flights depending on the weather and availability; ;

The seller will therefore give preference to the beneficiary of the said voucher who lives close to the place of flight, i.e. a geographical proximity of less than 100 km.

The day before the scheduled date of the flight, the beneficiary is contacted by the Company, based on the latest weather forecast (wind strength and direction) to specify:

- or the appointment time

- or cancellation of the appointment for weather reasons.

Appointment time depends on the weather (generally in the afternoon).

Nevertheless, the voucher holder expressly accepts that the appointment time may be delayed (even if exceptionally by several hours) and remains available.

Otherwise, the voucher will be lost.

ARTICLE 11 Cancellation conditions 

The beneficiary may cancel the reservation no later than 48 hours before the flight date.

Consequently, in the event of absence or cancellation less than 48 hours before the date of the flight, the voucher will be forfeited, the amount of the voucher remaining the property of the Company.

ARTICLE 12 Liability :

All our instructors are fully qualified, have third-party insurance and recent, CE-certified equipment, and take every possible safety precaution in our activity. 

Everything necessary is done to ensure safe flying. In the event of injury caused by tandem flying, the instructor's liability insurance will cover the damage caused.

The instructor reserves the right not to carry out the flight if he/she deems the aerological conditions too dangerous, or if he/she deems the passenger unsuitable.

In the event of the passenger not being able to take off, no refund will be given. Passengers may nevertheless pass on their gift voucher to a loved one on the day of the flight.

For safety reasons, it is expressly agreed and accepted by the Customer and the Beneficiary of the gift voucher that the weight of the Beneficiary of the gift voucher may not exceed 100 kg.

ARTICLE 13 Complaints and mediation

If necessary, the Buyer may submit any complaint by contacting the company using the following contact details contact@dune-parapente.comby sending an e-mail. 

In accordance with the provisions of art. L. 611-1 to L. 616-3 of the French Consumer Code, the consumer is informed that he/she may have recourse to a consumer mediator under the conditions set out in Title I of Book VI of the French Consumer Code.

If the consumer's request to the Seller's customer service department fails, or if there is no response within two months, the consumer may submit the dispute to a mediator, who will attempt independently to bring the parties together in order to reach an amicable solution.

ARTICLE 14 Intellectual property rights

Trademarks, domain names, products, software, images, videos, texts or more generally any information subject to intellectual property rights are and remain the exclusive property of the seller.

No transfer of intellectual property rights is made through these GTC. Any total or partial reproduction, modification or use of these goods for any reason whatsoever is strictly prohibited.

ARTICLE 15 Force majeure

The performance of the seller's obligations hereunder shall be suspended in the event of the occurrence of a fortuitous event or force majeure which would prevent such performance. The seller will notify the customer of the occurrence of such an event as soon as possible.

ARTICLE 16 Invalidity and modification of the contract

Should any of the stipulations of the present contract be null and void, this shall not invalidate the other stipulations, which shall remain in force between the parties. Any contractual modification is only valid after a written and signed agreement between the parties.

ARTICLE 17 Protection of personal data

In accordance with Regulation 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, the Seller implements the processing of personal data, the purpose of which is the sale and delivery of products and services defined in this contract. 

No automated decision or profiling is implemented through the ordering process.

Article 18 Applicable law and clauses

All clauses contained in these general terms and conditions of sale, as well as all purchase and sale transactions referred to herein, shall be governed by French law.

The nullity of a contractual clause does not entail the nullity of the present general conditions of sale.

The author of an offer remains bound by it as long as it is electronically accessible due to his fault.

L. 411-1 Consumer Code

 From the moment they are first placed on the market, products and services must comply with current regulations on personal health and safety, fair trading and consumer protection.
